By using our website, creating an account or placing an order, you agree to these Terms & Conditions and the policies they reference. If you don't agree, please don't use the website or buy from us.

This website is operated by Lumshade, 9202 W Center St, Milwaukee, WI 53222, United States (“Lumshade,” “we,” “us” or “our”). These terms apply to website use and retail purchases shipped to US addresses.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. You may use the website only for lawful purposes.

3. Accounts and communications

You're responsible for your account information and for activity under your account. Tell us promptly about any unauthorized use. We may suspend an account to protect customers or the website.

You agree to receive order, payment, shipping, return, safety and account messages related to your purchases. Marketing messages follow your preferences and applicable law.

4. Product information

We work to show accurate names, dimensions, materials, finishes, images, availability and prices, but errors can happen. Ceramic glazes, wood tones and fabric shades can vary slightly between batches and screens. Product images are illustrative.

Before ordering, check the dimensions, bulb base, maximum wattage and electrical rating listed on the product page against your space and bulbs.

5. Orders and acceptance

Your order is an offer to buy. An automatic confirmation email is not acceptance. We may limit quantities, correct errors, or decline or cancel an order because of availability, payment, pricing errors, suspected fraud or delivery limits. An order is accepted when we ship it. If we cancel after payment, we refund the full amount to your original payment method.

6. Prices, taxes and payment

Prices are in US dollars and may change before you buy. Applicable sales tax is shown at checkout. Standard shipping is free under our Shipping Policy.

Payments are processed through Shopify Payments and other providers shown at checkout, which may include Visa, Mastercard, American Express, Discover, Shop Pay, Apple Pay, Google Pay and PayPal. Promotions can't be combined unless stated. If we find an obvious pricing or description error, we may cancel the order or offer it at the corrected price before shipping.

7. Shipping and delivery

Orders follow our Shipping Policy. We process orders in 1–2 business days, and typical transit is 3–7 business days after dispatch. These are estimates, not guarantees. You must provide a complete, deliverable US address.

8. Cancellations, returns and refunds

You can cancel free of charge before your order ships. Returns follow our Returns & Refund Policy: eligible unused items in original packaging can be returned within 30 days of delivery, with no restocking fee. Contact us first for return instructions. Damaged, defective or incorrect items are replaced or refunded at no cost to you.

9. Safe use of lighting products

You agree to follow the product's instructions and labels. Use only bulbs with the correct base that don't exceed the maximum wattage, keep shades away from bulbs and flammable materials, use lamps indoors unless stated otherwise, and don't use a lamp with damaged wiring, plugs or sockets. Unplug a lamp before changing the bulb or cleaning it. Don't modify or rewire products.

10. Prohibited conduct

You may not:

• break the law, impersonate another person or provide false information;
• access accounts or systems without permission, introduce malicious code, scrape excessively or disrupt the website;
• copy, frame, resell or exploit website content except as the law allows; or
• get around quantity, promotion, payment or delivery restrictions.

11. Intellectual property and reviews

The website's design, text, graphics, logo and code are owned by or licensed to Lumshade. Other trademarks belong to their owners. You may use the website only for its intended purpose.

If you submit a review, photo or other content, you give us a non-exclusive, worldwide, royalty-free license to host, reproduce and display it to run and promote our store. You confirm you have the rights to submit it and that it's accurate and lawful. We may moderate content but aren't required to publish it.

12. Third-party services

Shopify, payment providers, carriers, tracking tools and linked websites are run by independent companies under their own terms. Except where the law makes us responsible, we aren't responsible for their services, content, outages or conduct.

13. Disclaimers

To the fullest extent permitted by law, the website and its general content are provided “as is” and “as available,” and we disclaim implied warranties about the website, including merchantability, fitness for a particular purpose and non-infringement. Any product warranty is the one we or the manufacturer provide in writing. Nothing here excludes warranties or remedies that can't lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Lumshade and its owners, staff and service providers are not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, data or goodwill, arising from use of the website or a product. Our total liability for any claim about an order won't exceed the amount you paid for the product involved. These limits don't apply where the law prohibits them.

15. Indemnification

To the extent permitted by law, you agree to defend and indemnify Lumshade against third-party claims and reasonable costs arising from your unlawful use of the website, violation of these terms or infringement of someone else's rights. This doesn't require you to indemnify us for our own negligence or unlawful conduct where the law prohibits it.

16. Governing law and disputes

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules, except where mandatory law requires otherwise. Before filing a claim, please email contact@lumshade.shop with your order number and a short description so we can try to resolve it in good faith.

17. General terms

If any part of these terms is unenforceable, it will be limited only as much as necessary and the rest will remain in effect. Not enforcing a provision isn't a waiver. You may not transfer these terms without our consent; we may transfer them as part of a business transfer. These terms and the policies they reference are the entire agreement about their subject.

18. Changes and contact

We may update these terms by posting a new version with a new date. Changes apply from that date forward. Continuing to use the website means you accept the updated terms.
